1. Agreement to Terms
By accessing or using WhatsAppReach ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service. The Service is operated by WhatsAppReach ("we", "us", "our").
2. Description of Service
WhatsAppReach is a B2B SaaS platform that enables teams to manage WhatsApp campaigns through Meta's official WhatsApp Business API. The Service provides campaign management, contact organization with consent tracking, AI-assisted message composition, delivery analytics, and a shared team inbox. The Service is a software tool — it operates on top of your own WhatsApp Business API account.
3. Acceptable Use
You may only use the Service for consent-based outreach to existing contacts, clients, and opted-in audiences. You must maintain consent records, honor opt-outs, and comply with applicable laws including POPIA, GDPR, and WhatsApp's terms of service.
You may not use the Service for: unsolicited cold messaging or spam; mass marketing to purchased lists; adult content; gambling; financial advice; political campaigning; pyramid or multi-level marketing schemes; unauthorized data access; or any activity that violates applicable laws or WhatsApp's terms.
4. Accounts
You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials. You must be at least 18 years old to use the Service. One workspace may have multiple users as permitted by your plan.
5. Billing and Payments
Paid subscriptions are billed monthly or annually as selected at checkout. Prices are displayed in multiple currencies. Payment processing is handled by our authorized payment provider. You agree to pay all applicable fees and taxes associated with your subscription.
6. Beta Access
The first 100 workspaces receive 2 months of free access ("Beta Period"). During the Beta Period, features may change, be added, or be removed. After the Beta Period, a paid subscription is required to continue using the Service.
7. Data and Privacy
Your use of the Service is also governed by our Privacy Policy. You retain ownership of your data (contacts, messages, campaigns). We do not sell your data to third parties.
8. Intellectual Property
The Service, including its design, code, and branding, is owned by WhatsAppReach. You may not copy, modify, distribute, or reverse-engineer the Service. "WhatsApp" is a trademark of Meta Platforms, Inc. WhatsAppReach is not affiliated with, endorsed by, or sponsored by Meta.
9. Limitation of Liability
The Service is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Service. Our total liability is limited to the amount you paid for the Service in the 12 months prior to the claim.
10. Termination
We may suspend or terminate your account if you violate these terms. You may cancel your subscription at any time. Upon cancellation, your access continues until the end of the current billing period.
11. Changes to Terms
We may update these terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated terms. We will notify users of material changes via email or in-app notice.
